Terms of Service
The rules governing the use of the GateWire decentralized infrastructure.
1. Acceptance of Terms
By creating an account, accessing the API, or using any part of the GateWire services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users ("Clients"), and Android Node Providers who access the Service.
2. Accounts & Security
- Registration: You must provide accurate and complete information when creating an account. Failure to do so constitutes a breach of the Terms.
- Credentials: You are responsible for safeguarding the API keys and passwords you use to access the Service. You agree not to disclose your API keys to any third party.
- Notification: You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Acceptable Use & API Restrictions
You agree not to use the Service for any unlawful purpose or any purpose prohibited under this clause. You agree NOT to use the Service to:
Strictly Prohibited Activities
- Send spam, unsolicited marketing, or "phishing" messages.
- Harass, abuse, or threaten recipients.
- Transmit viruses, malware, or harmful code.
- Attempt to bypass rate limits or reverse engineer the API.
We reserve the right to terminate your account immediately if we detect patterns of abuse or high failure rates indicating spam (e.g., sending to non-existent numbers).
4. Fees, Payments & Refunds
- Pre-Paid Credits: The Service operates on a pre-paid credit basis. Credits are purchased in advance and deducted upon the dispatch of SMS messages.
- Pricing: Prices per SMS are dynamic and may vary based on the recipient's network and your selected routing priority (Standard vs. Priority).
- Refunds: Unused credits may be refunded upon request within 14 days of purchase, subject to a processing fee. Credits used for attempted messages are non-refundable unless the failure was due to a GateWire system error.
5. Service Level & Delivery
GateWire utilizes a decentralized mesh network of Android devices. While we strive for high reliability:
- Best Effort: The Service is provided on a "best effort" basis. We do not guarantee 100% delivery rates due to factors outside our control (e.g., recipient carrier outages, node device signal loss).
- Maintenance: We may temporarily suspend the Service for maintenance or network upgrades. We will endeavor to provide notice prior to any scheduled downtime.
6. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
7. Limitation of Liability
In no event shall GateWire Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Algeria, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
